Course Description: This course provides a practical exploration of the lifecycle of an international arbitration, guiding students through each procedural stage from the notice of arbitration to the final award.
Using an adaptation of a real-world case, students will learn key strategies including the selection of an arbitral tribunal, crafting successful submissions, leveraging expert evidence, and understanding quantum submissions. Additionally, the course will address strategic document production requests (Redfern/Stern schedules). The course will also explore some of the key strategic differences in commercial vs. investor-State arbitration.
The class is highly interactive, employing a “learning by doing” model that includes case simulations, discussions, and targeted mini-assignments such as drafting document production requests and short Requests for Arbitration based on given fact patterns.
Please note that this course will be allocated to a member using an exemption as per article 15.03.03 of the MCLIU collective agreement.
